    To attract new readers, the magazine, published by Queensland-based Escape Media, offered an “Ultimate Escape” package, said to be worth more than $150,000.

    In May that year, Mr Lawler signed up to get the magazine for two years.

    In February 2016 he found out he had won the prizes. He told the magazine it had made his “dream a reality”.

    But by October 2016 things had changed dramatically. Mr Lawler believed he had been misled.

    He filed an application in the NSW Civil and Administrative Tribunal, alleging the prizes were worth only $120,000.



    And in July 2017, NCAT member Mark Gilson ordered Mr Lawler receive $25,000 in compensation.

    “I conclude that a reasonable person would find that the Ultimate Escape package was valued considerably less than $150,000,” Mr Gibson said in his decision.

    “Mr Lawler was induced to purchase his two-year magazine subscription partly on the representation made by the respondent in its Ultimate Escape promotions. Mr Lawler was entitled to hold reasonable expectations that if he was the winner of the promotion he would receive goods to the value of $150,000,” Mr Gibson said.

    “In the circumstances Mr Lawler is entitled to be compensated for the reduction in the value of the goods he received.”

    Escape Media appealed, saying the tribunal had “erred” because Mr Lawler hadn’t suffered a loss.

    Mr Lawler responded by claiming time to appeal had run out and that he had indeed been misled as defined by consumer law.

    The panel allowed the appeal to go ahead and last month found in Escape’s favour.

    The panel members said “in order to sustain a claim, a claimant ... must establish that damage or loss has been sustained.

    “On his own evidence Mr Lawler has had a windfall in the form of goods valued at approximately $120,000. He has suffered no loss.”

    The original decision set aside and dismissed.

    The magazine’s publisher Carlisle Rogers told News Corp Australia he was amazed “someone would look a gift horse in the mouth like that and pursue it legally when they had suffered no loss”.

    His company had been left with a five-figure legal bill, he said. The legal advice he had received was this couldn’t be recouped from Mr Lawler.

    “But in the end, justice, for what it is, prevailed,” Mr Rogers said.

    Mr Lawler declined to comment.

    Companies do this all the time. My brother won Wipeout. Chanel NINE had been advertising $50k for the WINNER to get entries. Bu the time it went to air they had changed it to $20k for the outright win. Used his images and videos in all manner of Promotions and advertising in Prime Time TV adverts including right through the Cricket season. They were great images. Then they got him on Kerrie Anne Kennelly Etc etc to promote e series. His promotions were great but NINE would only pay $20k.

    He was actually competing in the 4th Episode of the Series but they moved his Episode to the opening of the Serie because it was good viewing (for Wipeout LOL). So NINE got their monies worth.

    He copped the $20k and was happy with the First class flights, accommodation, meals and parties in Argentina. First time I've ever known him walk away from a fight.

    Companies suck.

    The series failed but that was becaus the commentators were pathetic.

    So what did it all legitimately tally upto, 120k? No mention if that was best price or retail, I would hazard a guess that all these comps base off list book price no discounts. Still though even at a stretch a 100 series with some ARB bits I cant see being 100k, the camper at best 20k and the boat minus trailer under 10k. Still as shown leaves a considerable hole for 'accessories'.

    Regardless the bloke is a toss, for what $120 for two years subscription to a magazine he obviously had an interest in he goes to tribunal for shortfall, turn it up buttercup.

    I'd say top RRP, or redbook high trade in the case of the LC100. The Camper is around $50k with options on road, and there's a fair bit of coin on the 'Cruiser, it's bloody scary when you start adding up the cost of decent bars, winch, snorkel etc. They would have also included the fitting charges as well, they can be eye opening as well.
